Terms of Service for Pure Oasis, LLC.

Welcome to Pure Oasis,LLC., a licensed cannabis dispensary located in Massachusetts. These Terms of Service (“Terms”) govern your access to and use of our services, including purchasing cannabis products from our dispensary, whether online or in-person. By accessing or using our services, you agree to comply with these Terms, as well as any applicable state and federal laws, regulations, and policies.

Please read these Terms carefully before using our services. If you do not agree with these Terms, you must refrain from using our dispensary’s services.

1. Eligibility

You must meet the following requirements to use our services:

  • You are at least 21 years old (or the legal age for cannabis use in Massachusetts, whichever is greater).
  • You are a Massachusetts resident or visiting Massachusetts and legally permitted to purchase cannabis under Massachusetts state law.
  • You are not prohibited from purchasing cannabis products due to any legal restrictions or other disqualifications.

2. Age Verification

We require all customers to verify their age before purchasing cannabis products. In-store, you will be required to present valid government-issued photo identification (e.g., driver’s license, passport) to confirm your age.

3. Legal Compliance

By using our services, you agree to:

  • Comply with all local, state, and federal laws and regulations related to the use and purchase of cannabis.
  • Only purchase cannabis products for personal use and not for resale.
  • Understand that cannabis consumption is illegal under federal law, and Pure Oasis, LLC. makes no guarantees regarding the legal status of cannabis under federal law.

4. Product Information

We make reasonable efforts to provide accurate and up-to-date information regarding the products we sell. However, we do not guarantee the accuracy, reliability, or completeness of any product descriptions, pricing, or availability. Product availability is subject to change without notice. Prices may change without prior notification, and we reserve the right to correct any errors in pricing or product descriptions.

5. Purchasing Cannabis Products

  • In-Person Purchases: You may purchase cannabis products directly from our dispensary during business hours. All transactions must be completed in person, and you must present valid identification upon entry.
  • Online Purchases: For those wishing to order online, products may be available for pre-order for in-store pickup or local delivery. Online orders are subject to product availability, and we make no guarantees that products will be reserved. You must present identification and provide payment upon pickup. 

6. Payment Methods

We accept payment via cash and, where applicable, debit cards. Payment methods may be subject to change, and we reserve the right to modify payment options as necessary.

7. Loyalty Program

We offer a loyalty program to eligible customers where points can be redeemed for discounts on products. Loyalty points are only earned on eligible purchases, and can only be redeemed in store and by the customer who originally earned the points. Loyalty points will be accrued at a rate of .05 points for every dollar spent, and can be redeemed in full-point increments. Loyalty points cannot be transferred and are not eligible to be converted into cash. Cannabis products can only be discounted to a lowest price of $0.01. Unused loyalty points will expire on a rolling 180 day period. Pure Oasis reserves the right to change or update its loyalty program at any time without notice.

8. Return and Refund Policy

Cannabis products are final sale and may not be returned or refunded except in cases of defective products or other circumstances as required by Massachusetts law. In the event of a defective product, you must return to the store with a receipt within 7 days of purchase to initiate an exchange. We are not responsible for any products that have been used, altered, or damaged after purchase.

9. Consumption of Cannabis

By purchasing cannabis products from Pure Oasis, you agree to consume the products responsibly and in compliance with all applicable laws. You must not:

  • Consume cannabis in public places where prohibited by law.
  • Operate a vehicle or heavy machinery while under the influence of cannabis.
  • Share or distribute cannabis products to minors or individuals not legally permitted to possess cannabis.

10. Privacy and Security

We respect your privacy and are committed to protecting your personal information. Our privacy policy outlines how we collect, use, and protect your personal data, including during transactions and through online services. Please review our Privacy Policy for more details.

11. Liability Limitations

To the fullest extent permitted by law, Pure Oasis, LLC. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our products or services. We make no representations or warranties regarding the safety, quality, or legality of the cannabis products we sell.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Any changes to these Terms will be effective immediately upon posting on our website or in our store. It is your responsibility to review these Terms periodically to stay informed of any changes.

13. Prohibited Activities

You agree not to engage in any activities that:

  • Violate these Terms, any applicable laws, or any third-party rights.
  • Cause harm or disruption to our services, operations, or systems.
  • Involve the use of false or misleading information during registration or purchase.

14. Dispute Resolution

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration, in accordance with Massachusetts law. You agree to waive any right to a jury trial or class action. Any disputes or claims must be brought within one year of the incident giving rise to the dispute.
